Morgan Stanley Option Traders Brace For A Pullback | Options ...

Put volume is accelerated on Morgan Stanley (NYSE:MS) today, and a group of these bearishly slanted option players are calling for the stock to lose ground over the next few months. Around 24,000 puts changed hands as of 11:17 a.m. ET today, representing an 84% mark-up to the average intraday volume, and a number of these contracts have crossed the tape at Morgan Stanley's May 21 strike. All of the 3,702 puts traded here have gone off at the ask price, implied volatility has ticked higher, and only 15 contracts currently make up open interest here, making it safe to assume that some of this volume is of the buy-to-open variety.

These out-of-the-money puts are being exchanged for a volume-weighted average price (VWAP) of $0.96, meaning traders will profit with each step south of $20.04 (strike less VWAP) MS takes through May expiration. This breakeven mark represents an 8.8% slide from current levels. At yesterday's close, delta for these puts was perched at negative 0.36, suggesting the options market is giving the positions a 36% chance of finishing in the money by expiration.

This appetite for short-term puts has been a developing trend in the options pits, per the stock's rising Schaeffer's put/call open interest ratio (SOIR). Since February 19, Morgan Stanley's SOIR has advanced to 1.38 from 1.04, as near-term put open interest jumped nearly 49%. This ratio now ranks in the 100th percentile of its annual range, indicating short-term speculators are more put-heavy now than at any other time within the past year.

Technically, the stock has been performing well in recent months. In addition to outperforming the broader S&P 500 Index (INDEXSP:.INX) by nearly 24 percentage points over the past 60 sessions, the equity is sporting a formidable 15% year-to-date gain. More recently, the security consolidated around its 40-day moving average, after tagging a fresh 52-week peak of $24.47 on February 20. However, a modest pullback this week has MS testing this trendline as a potential layer of support.

In light of the stock's strong start to the year, this rush toward puts could simply represent shareholders protecting profits against any additional downside in the near term.

At last check, the stock was down 0.3% to trade near $21.97.

Target cautious after weak holiday quarter, shares fall

this quarter and opening 124 Canadian stores, more than it has ever handled in a single year.

The Canada plans cut earnings by 48 cents per share in 2012 and should trim earnings by about 45 cents in 2013.

'LINKED WITH ECONOMY'

Target expects sales to rise about 2 percent this year, down from 5.1 percent growth last year, which had an extra sales week. Sales at stores open at least a year should rise in line with 2012's 2.7 percent increase.

The fourth-quarter marked Target's weakest holiday season performance since 2008, and some strength in January helped prop up what could have been even weaker numbers, said Sandy Skrovan, U.S. research director at Planet Retail.

"Walmart proved the victor over Target for the 2012 holiday season," Skrovan said, pointing out that Walmart U.S. same-store sales rose 1 percent in the quarter. "But Target won the year overall since, unlike Walmart, its affluent shopper base tends to be more insulated from economic swings."

While food and other basics sold well, shoppers held back from discretionary purchases like toys in an uncertain economy. Shoppers bought 0.7 percent more each time they shopped and the average spent was up 1.4 percent.

"Given the size of the company, anything that they do is linked inextricably with the economy," said Cowen & Co analyst Faye Landes. "In addition, they are in the fashion business and that business is clearly not without risk."

Target's holiday season included a disappointing showing for its collection of gifts sold in collaboration with high-end department store chain Neiman Marcus . The line that included designer dresses and dishes launched on December 1, and Target sharply discounted the goods even before Christmas.

Wal-Mart said last week that Walmart U.S. same-store sales were likely to be flat this quarter as consumers faced higher gasoline prices and smaller paychecks after the expiration of the U.S. payroll tax cut.

At Target, more shoppers used its credit and debit cards. The cards offer a 5 percent discount to foster customer loyalty, but the discount can also pressure margins.

Target said 15.5 percent of store sales during the quarter were paid with its cards, up from 14 percent in the third quarter and 10.8 percent a year earlier.

The fourth-quarter gross margin declined to 27.8 percent of sales from 28.4 percent a year earlier, due to the increased card usage, remodeling and markdowns on seasonal merchandise.

Target earned $961 million, or $1.47 per share, in the quarter, down from $981 million, or $1.45 per share, a year earlier. Target had fewer shares outstanding in the latest period.

Analysts, on average, expected earnings of $1.48 per share, according to Thomson Reuters I/B/E/S.

Adjusted earnings per share, excluding items such as costs related to Canada, rose to $1.65 from $1.49 a year ago.

Target tempered profit expectations back in early January, when it said earnings would just meet or somewhat exceed the low end of its prior view for net earnings of $1.45 to $1.55 per share and adjusted profit of $1.64 to $1.74 per share.

For the current year, Target forecast adjusted earnings of $4.85 to $5.05 per share, which would exceed the $4.76 it earned last year. It forecast first-quarter adjusted earnings of $1.10 to $1.20 per share versus $1.11 a year ago.

It was not immediately clear how the company's profit forecast compared to analysts' expectations.

Target previously said fourth-quarter sales rose 6.8 percent to $22.37 billion, with same-store sales up 0.4 percent. Same-store sales missed analysts' average target of 0.8 percent.

Meanwhile, Dollar Tree Inc , which sells low-priced items, said fourth-quarter sales soared 15.4 percent as it opens more stores and sells more food. Its shares jumped 12.5 percent.

Meet Carl, the Other Pistorius Facing Murder Charges

The Pistorius family are going to be court room regulars before the year is through. Besides little brother Oscar's murder case, another Pistorius sibling is facing murder charges in South Africa. Oscar's big brother Carl is being charged with culpable homicide, too.?

RELATED: Pistorius' Lawyers Go After the Prosecution's Witnesses

The South African eNCA's Karyn Maughan confirmed with Pistorius attorney Kenny Oldwage, the same one representing Oscar, that the elder Carl is facing culpable homicide charges related to a 2010 incident that resulted in a woman's death. Carl was supposed to appear in court on Thursday, the day before Oscar was granted bail, but his case was postponed until next month.

RELATED: Sponsors Turn Their Back on Oscar Pistorius

Now, you might be asking, why is he being charged for this now? In 2010, Pistorius was allegedly driving when his car struck a woman on a motorcycle, resulting in her death. Oldwage contends Pistorius was tested by police and proven to be sober at the time of the incident, and he believes that should ultimately lead to his innocence. The charges were originally withdrawn by the State prosecutors, but then reinstated later.?

RELATED: Oscar Pistorius Is Granted Bail

This isn't the first time the other Pistorius has made headlines this month, either. Carl's?Twitter account got hacked on Saturday. The alleged hackers said Oscar would be granting interviews, but alas, that's not the case. That incident led to the entire Pistorius family shutting down their Twitter accounts.?

PowerbyProxi debuts wireless charging solution, aims to fully integrate it into future smartphones (video)

PowerbyProxi debuts wireless charging solution, aims to fully integrate it into future smartphones video

The pathway to innovation is paved with failed attempts to produce wireless charging solutions that a) actually work and b) people genuinely want to use, but we've got yet another upstart here at Mobile World Congress willing to give it a go. PowerbyProxi's solution looks pretty similar to renditions we've seen from Fulton Innovation, but it's quick to point out the differences. The loosely-coupled method uses a bantam receiver that's "efficient enough to be integrated into the processor board of a smartphone without causing over-heating."

While previous industry designs have resulted in longer charging times than if the device were plugged into a wall socket, PowerbyProxi's solution reportedly "provides charging at the same speed as wired charging." In fact, it claims to offer the only system that can rejuvenate up to three devices at the same time at full power. If you're wondering what working group these guys are going to side with, that much is still up in the air -- it's remaining "agnostic towards the selection of an ultimate standard" for now.

We spoke with the company here at Mobile World Congress, and it confirmed to us that it's working with the top five major battery manufacturers, and we should see wireless AA and AAA cells "within 12 months." It wouldn't confirm how soon we'd see it in phones, tablets or laptops (yeah, it'll work in all of 'em), but it's clearly working with some of the top OEMs and hoping for the best. In the demo we witnessed, specially equipped Galaxy S III handsets charged alongside one another, even when barely clinging to the charging pad. Despite a bunch of metallic objects being heaped on the pad, it was intelligent enough to only send power to the phones, keeping gum boxes and coins cool, calm and collected. Head on past the break for quick video tour as well as a press release.

Microsoft says small number of its computers hacked

SEATTLE (Reuters) - Microsoft Corp said on Friday a small number of its computers, including some in its Mac software business unit, were infected with malware, but there was no evidence of customer data being affected and it is continuing its investigation.

The world's largest software company said the security intrusion was "similar" to recent ones reported by Apple Inc and Facebook Inc.

The incident, reported on one of the company's public blogs happened "recently", but Microsoft said it chose not to make any statement publicly while it gathered information about the attack.

"This type of cyberattack is no surprise to Microsoft and other companies that must grapple with determined and persistent adversaries," said Matt Thomlinson, general manager of Trustworthy Computing Security at Microsoft, in the company's blog post.

Over the past week or so, both Apple and Facebook said computers used by employees were attacked after visiting a software developer website infected with malicious software.

The attacks come at a time of broader concern about computer security.

Newspaper websites, including those of The New York Times, The Washington Post and The Wall Street Journal, have been infiltrated recently. Earlier this month U.S. President Barack Obama issued an executive order seeking better protection of the country's critical infrastructure from cyber attacks.

Galaxy Nexus broken

Hi,
my friend dropped his Galaxy Nexus on the floor and broke the screen (glass and display). But the phone seems to be working, since it gives the vibration and a little sound when turned on and off. When connected to the PC the storage is displayed correctly (all the photos are there). The problem is when i stick the SIM and when i try to call it fails to receive the call, but afterward you can see the LED notification blinking the white color about every 7 secs.
Since i cannot return for warranty because it was dropped, now im looking to buy the display. Prices seem a bit high...
The question that I've got is this: Is it worth to Change the Display? Can I be sure that the phone will eventually work?
It concerns me the fact that maybe something else is damaged.
Any help or thought is appreciated.
Many thanks.

PS: My friend is a Noob when talking about phones and he didnt know whether it was on 4.0.4 or 4.2.1

U.S. attorney: Criticism of Aaron Swartz prosecution is ... - CNET News

Carmen Ortiz, U.S. Attorney for Massachusetts

Carmen Ortiz, U.S. Attorney for Massachusetts

(Credit: U.S. Department of Justice)

Carmen Ortiz, the embattled U.S. attorney who charged the late activist Aaron Swartz with multiple felonies, has responded to critics by saying complaints about any prosecutorial overzealousness are "inaccurate" and "unfair."

Ortiz, 57, said in a radio interview that a wave of criticism -- which includes a congressional investigation, a court Web site hack, and a petition demanding her removal from office -- is off-base and uninformed.

"I have heard some of the claims in terms of being overzealous, or lack of supervision" of prosecutors in the office, Ortiz, who was appointed by President Obama and has previously denied any wrongdoing, told Boston's WBUR radio in an interview aired yesterday. "And I think they're actually very inaccurate. They're unfair. And they're unwarranted."

WBUR and Massachusetts Lawyers Weekly published a joint report into Ortiz's tenure that found "other prosecutions that parallel the Swartz case" that may "raise similar concerns about her hands-off leadership style, overzealousness, judgment and use of discretion at the grand jury and trial levels." In one case Ortiz's office brought, a federal judge threw out the charges against a defendant after declaring prosecutors' witnesses were so unbelievable that no jury would find them credible. In another, prosecutors accused a medical device company of defrauding surgeons but never talked to the alleged victims, who were prepared to testify for the defense.

"With respect to this notion that prosecutors pretty much run things here and that I don't make independent decisions -- that's completely absurd," Ortiz told WBUR. "We have a hierarchy of supervision. No AUSA in this office is able to bring a case, uh, just on their own." (An AUSA is an assistant U.S. attorney who reports to Ortiz.)

Swartz committed suicide on January 11 in New York. His family and friends have blamed Ortiz for filing 13 felony charges against the late activist for allegedly downloading academic journals he was authorized to access (but not access in such large quantities). "He was killed by the government," Swartz's father, Robert, said at his son's funeral.

Prosecutors accused Swartz of connecting a computer to MIT's network without authorization and retrieving more than 4 million academic journal articles from the JSTOR database. The advocacy group Demand Progress, which Swartz had helped create and which helped defeat the Stop Online Piracy Act a year ago, likened it to "trying to put someone in jail for allegedly checking too many books out of the library."

At the time the charges were filed, Ortiz compared Swartz to a common criminal in a press release. "Stealing is stealing whether you use a computer command or a crowbar," Ortiz said. Last month, less than three months before his criminal trial was set to begin, Ortiz's office formally rejected a deal that would have kept Swartz out of prison. Two days later, Swartz killed himself.

If Swartz had stolen a $100 hard drive with the JSTOR articles, it would have been a misdemeanor offense that would have yielded probation or community service. But the sweeping nature of federal computer crime laws allowed Ortiz and Assistant U.S. Attorney Stephen Heymann, who reportedly wanted a high-profile computer crime conviction, to pursue felony charges -- even though local prosecutors reportedly were content with a stern warning.

The Boston U.S. Attorney's office was looking for "some juicy-looking computer crime cases, and Aaron's case, sadly for Aaron, fit the bill," Elliot Peters, Swartz's attorney at the Keker & Van Nest law firm, told the Huffington Post. Heymann, Peters said, thought the Swartz case "was going to receive press and he was going to be a tough guy and read his name in the newspaper."

Harvard law professor Larry Lessig, who knew Swartz and worked with him, gave a lecture this week titled "Aaron's Laws: Law and Justice in a Digital Age." In it, Lessig called for a reform of U.S. computer crime laws, saying that "obviously first we need to fix" them, but also: "We have to fix dumb copyright. We're here in part because of dumb copyright laws."

In the WBUR interview, Ortiz said she didn't want to discuss Swartz's case in detail because of the congressional investigation. But she did say, in response to criticisms that Swartz was facing the possibility of decades in prison: "I will talk to you about proportion because that is important. We don't take our responsibility lightly. We try to, you know, do the right thing. We strive to do justice."

Earth's mantle helps hunt for fifth force of nature

Hey CERN, think you've got a big particle detector? Try using the entire Earth to hunt for a new fundamental force of nature.

So say Larry Hunter of Amherst College in Massachusetts, and colleagues. They have created a map of the spins of electrons deep within the Earth's mantle, which could be used to reveal the as-yet-unseen force as well as the strange particles ? known as "unparticles" ? that might carry it.

Such an experiment could also yield new insights into the planet's lower mantle, hundreds of kilometres below the surface.

We currently know of four fundamental forces: gravity, electromagnetism and the strong and weak nuclear forces. The hypothetical fifth force can be thought of as a version of magnetism that does not weaken as quickly with distance.

Unparticle exchange

Electromagnetic fields are produced when two particles exchange virtual photons that pop in and out of existence. But some physicists think another kind of virtual particle could also be exchanged, giving rise to a fifth fundamental force.

One candidate is the unparticle, a mysterious entity dreamed up several years ago. It has an unusual trait: its mass varies depending on the way we measure it, due to a property called scale invariance. As a result, unparticle exchange would not drop off as quickly as electromagnetism with distance ? potentially giving rise to measureable long-range effects.

Theory says this fifth force should tweak the amount of energy needed to flip the spin of an electron or neutron, due to interaction with another particle far away. Detectors have been set up to measure the effect of particles a few metres away on the spins of neutrons in the lab, but those have so far come up empty.

Different tack

So Hunter's team suggest taking a different tack. "We realised you can get a much bigger source if you use the whole Earth," he says.

Extreme conditions in the planet's mantle can affect the spins of electrons in various minerals, and these in turn affect the Earth's magnetic field. So by looking at geomagnetic field data, the researchers were able to infer the electron spins and how these spins would interact with particles in the lab via the fifth force.

They combed the results of three previous laboratory spin experiments to look for signs that electrons in Earth's mantle had influenced what was measured ? and found nothing.

But that doesn't rule out the fifth force, says Hunter. Rather, it tells us that this force must be very weak. Indeed, it suggests that any interaction between an electron in the mantle and a neutron in the lab via this weird new force must be a million times weaker than their gravitational attraction.

That's a useful new constraint on the theory, which originally said the two forces should have similar strengths, says Hunter, and means newer hunts for the force will have to be much more sensitive.

Incredible gift

"We often spend a decade struggling to get a factor of 10 improvement in a measurement," says Hunter. "This was like an incredible gift, as we didn't even have to do a new experiment."

It might sound like a long shot, but Hunter reckons it's worth it ? since a positive result would be evidence of a fifth force. "It's one of those low probability but high pay-off activities," he says. "Boy, if you see something, it really is exciting."

The experiment also raises another possibility: if future, more sensitive experiments reveal the fifth force, it could allow geophysicists to map out the electrons in the lower mantle in more detail by looking at how they influence particles on the surface. "You could set up detectors at various places on the Earth and probe down," says Hunter.

* Financials retreat after recent gains

By Ayai Tomisawa

TOKYO, Feb 22 (Reuters) - Japan's Nikkei share average fell for a second day on Friday on worries about the U.S. and euro-zone economies, dragging down euro-sensitive shares such as Sony Corp and Mazda Motor Corp.

The Nikkei fell 0.5 percent to 11,252.41 by the midday-break, retreating from a 52-month high of 11,510.52 hit on Wednesday.

Investors were cautiously watching to see if the United States backs Japan's plans to revive its economy, while uncertainty around this weekend's Italian elections also capped demand.

"Investors are watching how the long-term interest rates, CDS spreads and the euro will move after the election. Now that the Nikkei has hit a new high and tested the 11,500-line (earlier this week), the market is vulnerable to profit-taking triggered by negative overseas factors," said Nobuhiko Kuramochi, a strategist at Mizuho Securities.

Exporters with high exposures to the euro zone economy tumbled, with Mazda Motor Corp falling 1.9 percent and Sony Corp shedding 2.7 percent after business activity indexes dealt a blow to hopes the euro zone might emerge from recession soon, showing the downturn across the region's businesses unexpectedly grew worse this month.

Square Enix's Shinji Hashimoto announces that he has a Final Fantasy PS4 announcement for E3

What a tease. Brand director Hashimoto-san, who's worked on the likes of Kingdom Hearts, Chrono Trigger and a raft of Final Fantasy titles over the years, took to the stage. And what did he have to tell us? Could Square Enix be working on yet another Final Fantasy title for Sony's new PlayStation 4? Well, yes. Naturally. But that was about it, adding that they are "preparing for development of a Final Fantasy title. Please be excited for E3 this year." What's another few months? Right?

Mark Nepo: Come With Me

I was on retreat, in deep silence and solitude, when I felt a moment of great aliveness and a sudden want to share that sense. It led to this poem, which I thought was a song for company. It was only upon reading it later that I realized that the voice of the poem was a call from my soul for me to spend more time with it.

Come With Me

I can't be more in love with life.
And still, your eyes crack me wider.
It's more than I can stand, if not for
the flower of all time slipping from
my mouth when all words fail. Come
with me to the ledge I've found within.
You can see the valley below where the
greatest minds have all been shattered
by love. I am so at peace on that ledge,
halfway between life and death. This
sweetness is like a nail of light that
pins me to the moment we have.
Come, please. I can't stand
all this wonder by myself.

A Question to Walk With: A month ago, we discussed the notion that everyone has their own genius, their own attendant spirit. What is your attendant spirit, your soul asking of you today?

Caffeine linked to low birth weight babies

Tuesday, February 19, 2013

Maternal nutrition is important to a developing embryo and to the health of the child later in life. Supplementing the diet with specific vitamins is known to increase health of the foetus for example folic acid (vitamin B9) reduces the risk of spina bifida. However not everything an adult might consume is beneficial to a developing baby. New research published in BioMed Central's open access journal BMC Medicine shows that caffeine is linked to low birth weight babies and that caffeine from coffee in linked to increasing length of pregnancy.

Along with nutrients and oxygen, caffeine feely passes the placental barrier, but the developing embryo does not express the enzymes required to inactivate it efficiently. The WHO currently suggests a limit of 300mg per day during pregnancy but some countries recommend a limit of 200mg, which can be less than a single cup of coffee from some high street cafes.

To investigate the impact of maternal caffeine during pregnancy on babies, a research team from the Norwegian Institute for Public Health used information about mother's diet and birth details collected over ten years. After excluding women with medical and pregnancy-related conditions almost 60,000 pregnancies were included in the study. All sources of caffeine were monitored in the study: coffee, tea, fizzy drinks, as well as food including cocoa-containing cakes and deserts and chocolate.

Explaining their results, Dr Verena Sengpiel, from Sahlgrenska University Hospital, Sweden, who led the project said, "Although caffeine consumption is strongly correlated with smoking which is known to increase the risk for both preterm delivery and the baby being small for gestational age at birth (SGA). In this study we found no association between either total caffeine or coffee caffeine and preterm delivery but we did find an association between caffeine and SGA. This association remained even when we looked only at non-smoking mothers which implies that the caffeine itself is also having an effect on birth weight."

In fact they found that caffeine from all sources reduced birth weight. For a child of expected average weight (3.6kg) this equates to 21-28g lost per 100mg caffeine per day. But it was not just caffeine, but the source of caffeine, which affected pregnancy outcomes. Caffeine from all sources increased the length of the pregnancy by 5hr per 100mg caffeine per day, but caffeine intake from coffee was associated with an even longer gestational length - 8hr extra for every 100mg caffeine per day.

This association means that it is not just the caffeine in coffee which increases gestational length but either there must be a substance in coffee which is responsible for the extra time or there is a behaviour associated with coffee drinking not present in women who drink only tea (for example). SGA babies are at higher risk of both short term and lifelong health problems and it seems from these results that since even 200-300mg caffeine per day can increase the risk of SGA by almost a third these recommendations need to be re-evaluated.

Church Financial Leadership: Stop Charity & Benevolence

Charity: the voluntary giving of help, typically money, to those in need.
Benevolence: An inclination to perform kind, charitable acts

Too often people are charitable and benevolent because they a need and want to help meet that need. They give money to fight homelessness, hunger, poverty, illiteracy, illness, etc. All these gifts are well-intentioned - no one gives because they are mean-spirited.

However, I do wonder at the motivation of the gift. Some gifts are given in order to receive a tax write off. Some gifts are made in order to look good in the eyes of others. Some gifts are more personal because of a family member's situation.

To me, it seems that charity and benevolence is done from a desire to attack the cause of a condtion. Don't get me wrong, I don't like the causes of hunger, poverty, illiteracy, etc. any more than anyone else. I find them despicable and wish they were eliminated. However, I do wish that the reason people were generously-minded was from a philanthropic viewpoint.

Philanthropy: The effort or inclination to increase the well-being of humankind, as by charitable aid or donations (from the Greek: philo = love and anthropos = man)

Before you say this is "just semantics" and that philanthropy is the same as charity or benevolence, think about the motivation for giving. Philanthropy is done because you want to help a person whereas charity is cause-related. If benevolence is to fight?homelessness, philanthropy seeks to work with "Mike" or "Susie" to find them a place to live and to address the situation that made Mike or Susie homeless in the first place. Charity is about giving left-over clothes or money so that an organization can do something to meet a need. Philanthropy is about you getting personally involved because you love people as individuals, not as causes or charities.

Jesus didn't come to be charitable or benevolent. Jesus came because He loves humanity and wanted to get personally involved in our situation, to get his hand dirty in our mess, and to face us in the muck and mire in which we had gotten ourselves. This was about human love.

Here is another way to categorize charity versus philanthropy. It comes from the 12th century Jewish philosopher Maimonides who wrote the Eight Levels of Giving:

  1. A man gives, but is glum when he gives. This is the lowest degree of all.
  2. A man gives with a cheerful countenance, but gives less than he should.
  3. A man gives, but only when asked by the poor.
  4. A man gives without having to be asked, but gives directly to the poor who know therefore to whom they are indebted, and he, too, knows whom he has benefited.
  5. A man places his donation in a certain place and then turns his back so that he does not know which of the poor he has benefited, but the poor man knows to whom he is indebted.
  6. A man throws the money into the house of a poor man. The poor man does not know to whom he is indebted, but the donor knows whom he has benefited.
  7. A man contributes anonymously to the charity fund that is then distributed to the poor. Here the poor man does not know to whom he is indebted, neither does the donor know whom he has benefited.
  8. Highest of all is when money is given to prevent another from becoming poor, as by providing him with a job or by lending him money to tide him over a difficult period. There is no charity greater than this becasue it prevents poverty in the first instance.
Lead On!
Steve

Google's Silence on Privacy Policy Irks EU Regulators

Privacy

European officials today criticized Google for not responding to their privacy-related inquiries in a timely fashion.

As a result, France's CNIL (Commission nationale de l'informatique et des libert?s) - which is representing the European Commission's Article 29 Working Party - said today that it would set up a working group that would examine the search giant's policies.

That group should be in place by summer. CNIL said it will submit its proposal at the next Article 29 Working Party plenary session on Feb. 26.

In a statement, a Google spokeswoman said "our privacy policy respects European law and allows us to create simpler, more effective services. We have engaged fully with the CNIL throughout this process, and we'll continue to do so going forward."

The CNIL's battle with Google goes back almost a year. At issue is an update to Google's privacy policy that went into effect on March 1, 2012. The revamp consolidated 70 or so privacy policies across Google's products down to one. But with this change, Google also switched to one profile for users across all services rather than separate logs for offerings like YouTube, Search, and Blogger.

It's that account consolidation bit that had privacy advocates up in arms. In early Feb. 2012, the Article 29 Working Party asked Google to "pause" its privacy policy update, but Google declined.

CNIL responded by asking Google for more details about its plan, and Google submitted its answers in April. CNIL said that response was incomplete and issued several recommendations in October that covered how Google might improve its privacy policies. Google has not yet responded to those recommendations, prompting today's statement.

Carlsberg profit lags as Russia stalls

COPENHAGEN (Reuters) - Danish brewer Carlsberg reported a weaker-than-expected quarterly profit after sales stalled in its key Russia market and fell in western Europe.

The world's fourth biggest brewery scrapped its long-term margin forecasts due in part to market uncertainty, although it forecast operating earnings in 2013 to rise slightly to around 10 billion Danish crowns ($1.79 billion) from 9.8 billion a year earlier.

The group's operating profit (before special items) in the fourth quarter rose to 2.15 billion Danish crowns ($384.79 million), slightly lagging an average 2.30 billion crowns estimate in a Reuters poll.

"For 2013, the Carlsberg Group expects beer market dynamics for all three regions to be similar to 2012," the company said in a statement.

"2013 volumes are expected to be impacted by destocking in France and Russia," it said.

Fourth-quarter revenue rose to 15.93 billion, exceeding an average 15.63 billion crowns estimate in the poll.

It forecast a mid-single digit percentage rise in annual adjusted net profit.

Technomad Loudspeakers Upgrade Audio In French Football Stadium

Stade Francois Coty, a French football stadium in the Corsican city of Ajaccio, France, has completed audio upgrades compliant to league standards, with seven Technomad advanced audio loudspeakers covering the entire venue.

Home club AC Ajaccio recently transitioned to Ligue 2, also known as Division 2 in the LFP French professional football league. The league-imposed audio upgrades required a higher measure of intelligibility and audio coverage throughout the stadium ? a quality the previous audio system lacked.

Systems integration company Atacc International worked with French Technomad dealer Audiopole to develop the new system, ensuring intelligible voice and music is audible throughout the stands. The design also considered financial and structural challenges, including minimal hanging points for the latter.? But the challenge of protecting gear in the open stadium air was top of mind for both companies.

?Our main concern was undoubtedly the weather, and Technomad loudspeakers are 100 percent weatherproof,? said Alain Castelli, manager, Atacc International.? ?They can withstand wind, rain, moisture and temperatures as cold as 0 degrees Celsius in the winter; and as hot as 30 degrees Celsius in the summer.? The sea is also nearby, so salt corrosion was another concern.?

Audiopole provided an acoustic study of the stadium prior to installing the seven Technomad Noho loudspeakers in the stands, behind the goals, and within a VIP space and visitors area.? The study determined that the Noho was the best model for the project, providing excellent coverage and full-range audio ? including ideal sensitivity for speech.? The complete system includes Yamaha amplifiers and mixers, a Shure ULX Series microphone, and an automated playout system for security announcements.

?This was our first time using Technomad, and we are very pleased,? said Castelli.? ?The observed power of the Nohos in comparison to their size is very impressive, and the responsiveness from Audiopole was also excellent.?

Syrian opposition won't talk to officials linked to crackdown

AMMAN (Reuters) - Syria's opposition coalition is ready to negotiate President Bashar al-Assad's exit with any member of his government who has not participated in his military crackdown on the uprising, coalition members said on Friday.

Syrian authorities have given no formal response to several offers of talks in recent weeks. But officials say they cannot accept pre-conditions about Assad's departure and have privately dismissed what they say are no more than media initiatives.

The political chasm between the sides, along with a lack of opposition influence over rebel fighters on the ground and an international diplomatic deadlock preventing effective intervention, has allowed fighting to rage on with almost 70,000 people killed in 22 months of conflict, by a U.N. estimate.

Opposition leader Moaz Alkhatib made an offer of negotiations last month without consulting the coalition's 70-member assembly, prompting criticism from a powerful bloc within the movement dominated by the Muslim Brotherhood.

Syrian Foreign Minister Walid al-Moualem is due to visit Moscow, one of Assad's main foreign allies, later this month. Russia also hopes Alkhatib will visit soon in search of a breakthrough to end the bloodiest of the Arab Spring uprisings.

But coalition members say no date has been set for an Alkhatib trip to Moscow and Syria's Foreign Ministry played down suggestions that Moualem and he could meet there, saying any dialogue must take place in Syria.

An overnight meeting of the coalition's 12-member politburo in Cairo endorsed Alkhatib's initiative, although it set guidelines for any peace talks which will be presented for approval by the full assembly next Thursday.

"These guidelines stipulate that Bashar al-Assad and all the security and military leaders that (have) participated in the killing of the Syrian people and whose hands are stained with blood have no place in the Syria of the future," coalition member Abdulbaset Sieda told Reuters in Cairo after the meeting.

"We agreed to reassure the Syrian brothers from the (ruling) Baath Party whose hands are not stained with the blood of the Syrian people that they are partners in the coming political process."

Another opposition member said next week's gathering of the full coalition would try to revive plans for a provisional government, undermined so far by divisions among Assad's foes.

Walid Bunni, one of a handful of liberals in the Islamist-heavy assembly, told Reuters that Assad and his military and intelligence officials could not be part of any negotiations.

"Bashar and his cohorts will not be party to any talks. We will not regard those present from the government's side as his representatives," Bunni said.

He said the meeting addressed how to deal with Iran and Russia, Assad's main supporters, after Alkhatib met the foreign ministers of Russia and Iran in Munich earlier this month.

NO SIGN OF DIALOGUE

Syria's Foreign Ministry complained to the United Nations on Friday over what it said was pressure by Turkey, which backs the rebels, on Syria's opposition to reject any negotiated solution. The ministry said Turkey was "training and arming terrorist groups including al Qaeda" to fight Assad's forces.

Turkey has repeatedly denied arming or training the Syrian insurgents.

Alkhatib has said he is willing to hold talks with Assad's representatives in rebel-held areas of Syria or outside the country to try to end the conflict. Syria's minister for national reconciliation, Ali Haidar, initially gave a positive response, saying he was willing to travel abroad to meet him.

But in an interview on state television this week Haidar reiterated the government's position that any serious dialogue must be on Syrian territory and said the opposition had not formally presented any proposals.

"There is no initiative at the table of the Syrian government," he said. "The government is not a media office to answer ideas through the media."

Haidar has also said the authorities reject any dialogue that aims "to hand power from one side to another".

Alkhatib has headed the Syrian National Coalition since it was founded last December in Qatar with Western and Gulf backing. He has quietly built up a student following and links with civic and religious figures across Syria, although he has no control over armed insurgents seeking Assad's overthrow.

Rebels captured the town of Shaddadeh in the eastern, oil-producing province of Hasakah on Thursday after three days of battles in which activists said 30 members of the al Qaeda-linked, anti-Assad, Nusra Front and 100 soldiers were killed.

The United Nations food agency WFP said on Friday that an estimated 40,000 people had fled Shaddadeh for the provincial capital Hasakah, 45 km (30 miles) to the north.

But the army's firepower in the east remains formidable, rebels say. An activist in the city of Deir al-Zor, where rebels launched an operation this week to expel Assad's forces, came under the heaviest artillery barrages since the start of the conflict from the airport and surrounding bases to the south.

In Damascus, fighting continued on the edge of central areas where rebel brigades have encroached after breaching the Assad forces' defensive lines at the ring road two weeks ago.

Assad's elite Republican Guard and Fourth Division Forces, belonging mostly to his Alawite sect, remain dug in on Qasioun Mountain on the northwestern edge of the capital, at the Mezze military airport on its western edge and in surrounding hills in Somariya and an Alawite enclave known as Mezze 86.

"I hear the shelling from Mezze airport and Somariya and Mezze 86 on Daraya and Moadamiya. From Qasioun it targets Jobar and the southern neighborhoods," said a local witness.

REBEL TANK BARRAGE

Video footage showed a tank captured by the Liwa al-Islam Brigades, one of the biggest rebel units operating around Damascus, shelling a purported army position in the Eastern Ghouta, an expanse of farmland and urban areas from where opposition forces have been attacking the capital.

Illustrating the dominance of Islamists in the armed opposition, Liwa al-Islam was established by the son of a Salafist sheikh in Saudi Arabia, a major source of funding for the rebels, along with Qatar.

In the northern province of Idlib, where rebels shot down two air force jets on Thursday, Assad's forces shelled the town of Maarat al-Numan after days of heavy clashes around the military base of Wadi Deif on the main north-south highway.

Activist Anas Najm, speaking by phone from the town with the sound of jets buzzing and bombardment in the background, said rebels retook the highway from the army last week.

"The road to Turkey is basically now all under opposition control, except in an area near Aleppo where the regime has a big fortified roadblock," he said.

The Syrian Observatory for Human Rights, which monitors violence in Syria, said dozens of people were kidnapped on Thursday in apparent tit-for-tat sectarian operations in Idlib.

It said pro-Assad armed groups from the Shi'ite Muslim villages of Fua and Kafraya seized four vehicles carrying men and women from the Sunni Muslim villages of Saraqeb, Sarmeen and Binnish. Another group captured 40 people from Fua and Kafraya, it said.

The rebels come mainly from Syria's Sunni majority, while the Alawites follow a faith derived from Shi'ite Islam.

Melbourne Jewish Community Rocked by Revelation That Israel?s Prisoner X Was Ben Zygier

On Tuesday morning East Coast time, an Australian news program ran an explosive story claiming that Israel?s Prisoner X, the Jewish?s state?s most infamous prisoner, was an Australian citizen named Ben Zygier. The story has all the hallmarks of a classic spy novel: forged passports, espionage, information suppression, and accusations of treason. But the tale of Prisoner X?who died under mysterious circumstances in 2010 in solitary confinement, having allegedly hanged himself in the maximum security cell built for Yitzhak Rabin?s assassin?is not only riveting for its John Le Carr? flourishes. To me, it?s also shocking because Ben Zygier is a Jew from the small, tight-knit community in Melbourne where I grew up.

The question of how Zygier, raised by a prominent Zionist family, came to be imprisoned by the Israeli government in the harshest, most isolating conditions possible is one that is now dominating conversations in every quarter of the Melbourne Jewish community. Worldwide, there?s been a tsunami of media coverage, speculating on everything from the reason for his imprisonment?the dominant narrative was that he was a Mossad agent who betrayed Israel?to the whereabouts of his Israeli wife and two young children. But among Melbourne?s Jew these questions have a slightly different tenor?one of distress and sympathy for the Zygier family. In quiet conversations, everyone is wondering: How did this happen to one of ours?

People often describe the Melbourne Jewish community as a shtetl or a village, and it?s not hard to see why. Affectionately known as the ?Bagel Belt,? it?s a cluster of affluent, upper-middle-class suburbs about 10 kilometers south-east of the city. Malvern?where the Zygier family lives?is a lovely, leafy grid of Victorian homes and private schools. From there it?s a short drive to East Saint Kilda, known for its full-scale replica of 770 Eastern Parkway, the Lubavitcher Rebbe?s headquarters, and Elsternwick, where I grew up, which has three Jewish bakeries and one bagel shop within 100 meters of each other.

The proximity isn?t just geographic. Jewish Melbourne is a place where everyone knows everything about everyone else: What they cooked for Shabbos dinner, what their university entrance exam score was, why they?re embroiled in a broyges (dispute) with the president of their shul. It?s not dissimilar to Teaneck or Skokie, but it?s also very unique, because the community is mostly comprised of the children and grandchildren of Polish Holocaust survivors. The trauma of the war?and the threat, whether real or imagined, of the re-emergence of virulent anti-Semitism?runs deep in the bones of the community, which has trained its own private security group, the CSG, to protect its schools, synagogues, institutions, and events. That history helps explain the depth of Zionist commitment among Jews from Melbourne, and Australia generally. (The Jewish Agency estimates that 9,000 Jews have made aliyah from Australia, a high percentage for a community now numbering 97,000.)

The Zygier name is well-known in the community: Geoffrey Zygier, Ben?s father, was once the head of the JCCV, the most important Jewish organization in the state of Victoria, of which Melbourne is the capital. He?s currently the executive director of the B?nai B?rith Anti-Defamation Commission, the Australian equivalent of the ADL. The JCCV and the ADC, like almost every Jewish institution in Australia, are politically conservative and ardently pro-Israel. David Langsam, a Jewish journalist in Melbourne acquainted with Zygier, described him as ?an exceptionally decent man ? generous and polite, even when disagreeing on Middle East policy.?

Ben attended Bialik, a secular Zionist day school with a reputation for academic excellence and privilege, and was a member of Hashomer Hatzair, or Hashy, as it?s known in Australia. After high school he went to Israel with Hashy on Shnat, a gap-year program popular with graduates of Zionist youth movements, who return home to lead meetings and camps for children in their communities. It?s not uncommon for ?Shnatties? to return to Australia vowing to make aliyah and serve in the IDF, and many of them?including Ben Zygier and a number of my friends?have done so.

Though many people from my community were to connected to Ben Zygier, most people were reluctant to speak on the record about the Prisoner X story, citing personal connections to Ben?s family or a desire to remain respectfully quiet in light of the their grief. Melbourne Jews are tight-knit and extremely protective of their privacy as a community, so it isn?t surprising to see people are closing ranks in support of the Zygier family. The sympathy for their loss is profound, even urgent: Not only did they suffer the death of their child in 2010, they?re now witnessing a global interrogation of his character.

At the time of Ben?s death, I remember hearing vague reports of a young Australian man who had died in mysterious circumstances in Israel. People in the community have told me that there were rumors circulating that he had committed suicide?but even the word rumor seems too sensationalist, as his death was only discussed in the most discreet language, with utmost respect for the family?s grief and privacy. Given the family?s silence, all we know now is what the papers are reporting: Zygier was arrested and held in detention for several months in 2010, presumably for having grievously compromised Israeli state security. He was found hanged in his cell in December of that year.

On Facebook there are tornadoes of conjecture whirling around and around on repeat. ?Those who know what?s going on aren?t saying anything,? said Langsam, ?and those who don?t know what?s going on are discussing it nonstop on social media.? On Thursday, anonymous statements from friends started to trickle into the media, but the veil of secrecy cast over the case by the Israeli government seems to have been extended by default to Melbourne.

Anthony Frosh, an editor of a popular community blog, Galus Australis, told me that ?there are two prevailing reactions right now: those who are defensive of Israel, who say it?s a media beat-up that has been sensationalized, and those who think we have a responsibility to demand justice.? How will this scandal affect the faith of Australian Jews in Israel, the country many have given their children to? And on the flip side, how will this affect the relationship between the Jewish community and the Australian government, which was strained in 2010 by the revelation that several Jewish Australians had willingly handed their passports over to the Israeli government for use in security exercises?

It seems that a rupture is unlikely to occur. There?s certainly a diversity of political opinion in the Australian Jewish community, but the majority of the people, and certainly the leadership, tends toward defending Israel at all costs.

I was up late last night trawling the Internet for fresh news on the case of Prisoner X. Mostly I read the same information again and again, recycled by different media outlets and news agencies, and I found myself seriously pondering for the first time the phrase ?X marks the spot.? As a symbol it seeks to nullify and eliminate, but it also draws attention to itself; to what lies beneath the surface. It?s an apt metaphor for not just the disappearance of Ben Zygier, but for his community?s response to his disappearance: seeing but not seeing, speaking but not speaking.
